Agent Immobilier problem

Help needed with now not wishing to sell.


I recently had to advertise my property for sale for a variety of reason and on advice from an agent put a very low price upon it and even at that price did not consider that I would receive any offers at all as there is a vast amount of renovation work needed.


As it turns out the agent has found someone who does wish to buy.


Just as they found a buyer I was changing my mind about selling and when I spoke to them today I said I no longer wished to sell even though they had a buyer.


The next thing I get is an email threatening me that they will put the matter in the hands of the notaire or even advocate.


In the mandate which I signed was a clause where it would be a contract for 3 months but with a "tacit" renewal every 3 months after that unless terminated in writing 14 days notice.

Passé ce délai, sauf révocation à tout moment par lettre recommandée avec avis de réception, sous réserve d'un préavis de quinze jours, il se poursuivra par tacite reconduction par périodes de 3 mois, la tacite reconduction ne pouvant aller au-delà de deux années.


What can I do just ignore them and tell them to take it off the market, I don't want to sell now so it is surely up to me what I can do?


if the buyer doesn't come up with the asking price then you're in the clear, can refuse and take it off the market - recorded delivery letter and notice period as per the mandat is normal :-)

If the buyer comes up with the asking price and is bona fida then you've got a bit of a fight on your hands :-( I'd take some professional advice if i were you, try and contact those who work in immo here on sfn too (I no longer do so).

and be sweet by sending a recommended letter (with confirmation of receipt) that you consider the contract with him/her as void and has ended, - but you will enjoy to sue for harassment. This is 'pilepalle", laughable! Don't go for all this whiner even when it is kind of fun...

Thanks will keep that in mind and still wait and see what the agent does.

Something to think about, who are the supposed buyers. If it is someone connected to the agents you may have a case. I now have a mantra - send a letter and cc to everybody you can,the papers, all government departments, Uncle Tom Cobbley and all. If they suggested a low price you may have a misrepresentation case if they are tied to the purchasers. Fight the buggers. x

Thanks, I thought about that but I am back here in UK at moment and don't really want to have to go back for sometime, think i will just wait and see what they do!

We were in a similar position last year. The OH had signed a mandate for a full year and I am told that you have to sell if somebody offers the asking price. Gave me many sleepless nights but we had put the house on at the top end of the price range and only had one close call. Our agent had reduced the price without permission whilst we were in the UK which also gave us a get out clause. My advice would be to go and get legal representation. And as always here, wait for the registered letter - they may not proceed.
