Folding micro enteprise

new here i have a question.Does anyone know anything about declaring micro enteprise bankrupt.I owe rsi 10k and have to pay another 7K this year but just dont have the work/income to do this or is a bag in box and bottle of pills the only way out :-).

What winds me up most is im out on the road working 65 hrs a waeek not ripping anybody off and have a list as long as my arm of happy clients yet i get punished for it yet i would be applauded if i sat at home all day watching jeremy kyle and sponging off the state.

According to the link tough ( read questions and answers below the article ), if you have "hypothéquéed" your house beforehand, it's not valid, same if you have applied for a loan and you have "portéed garants" for yourselves. Nearly forgot : info to be checked with the Notaire, as usual.

Good point, Christine, mine cost 300€, very simple process at hte notaire's.

About the cotisations : Really ? - interesting. I might contact you about that in the near future ! :)

If you own your own place, it 'd be a good idea to see a trustworthy notaire ASAP and declare your house "insaisissable" so it cannot be taken from you - just in case...

... Unless, for example, the house you live in is owned in your wife/ partner's name only and there is no "mise en commun" des biens ( but instead a "separartion des biens " ; what is yours is not hers, and vice versa).

why oh why - you said it, Tracy! yep, year 2 doesn't frighten me too much, it's year 3 that'll be the real nightmare :-O

I too am entreprise individuelle now and my social charges are currently much smaller than I was paying on AE. I am busily paying off all other debts so I can meet the massive charges of year 2 and 3, when they come around. Why oh why, does the French governement sort out this mess - can they not see what they are doing to small businesses - it's not rocket science, just simple maths and cash flow.

I know it's not allowed but I have French friends who have managed to change whilst continueing the same activity yet declaring something a little different - you just need to be a little machiavelian ;-)

I'm out of the AE scheme after 4 years in and into the normal one and now face the normal forfait charges :-O

Yes, it is possible, a friend of mine did this last year. It is long and complicated but he worked with his accountant, had to give up all his tools, van etc but he is now happily employed and swears it's the best thing he ever did. He is sleeping at night , the money in his paypacket is all his and he would never go back to being self employed.

The important thing is to take professional advice, now, the longer you wait the worse it gets, good luck and I hope you get it sorted.

Sorry Andrew, you cannot close a business and then restart in the same trade as an AE. There is an eighteen month waiting period and the areas of commerce are very narrow so you cannot start as something slightly different. We went through this last year. Oh the joys of bureaucracy.

I think you need professional advice on this one because, as I understand it, it's not the business that owes money to the RSI but you as an individual. It may be worth closing the business asap and starting up as an auto-entrepreneur (can't be sure as no info is given). That way you can still work but only pay cotisations on what you earn.
