Me too Says more about me than the photo. But you know it wasn't acceptable. rules, regulations, terms and conditions.
Also reminds me of a Picasso story.
When he was living in Paris during WW2 he was visited in his studio by a couple of high ranking German officials. One of them picked up a cubist portrait and asked "Who is this?" Picasso told him and the officer replied "It's rubbish! Doesn't look anything like her" So Picasso said "Do you have a photograph of your wife?" The Officer proudly brought out his wallet, opened it and handed Picasso the a small photograph "Now this is a good likeness Not like your terrible paintings Herr Picasso" "Oh!" Picasso replied " I see your wife is black and white and only two inches tall"

My “sue them” comment was only half way serious as I think it’s a complicated and mostly futile exercise but I do think it’s a hell of a cheek on the part of the film processing company or their employees (who were the only other ones to handle my friend’s photos) to steal that image without any ‘by-your-leave’ of the rightful owner and make a heap of loot from it and not offer her a bean...
As for Mr B Dylan signing a model release form whist performing before thousands in public...
Fortunately, Louise, like myself, doesn’t take life - or photography - too seriously.
If you take a photo of someone and keep it in your photo album or on the computer or in a frame on your wall its no problem, your not breaking any law. If, however you publish that photo on a website or in any other form a signed model release form is required. This gives you permission to use the photo. There are even buildings which if you photograph them and publish you are infringing the law.
So, my question is -
Do you have a signed model release ? If not then you are liable for prosecution by the person in the photo. Crazy world we live in.
The thing which i find disconcerting are the amount of people who are urging you to sue.
And would like to ask. Have you ever taken a biro home from work?(by mistake of course)
Please practice patience and generosity. Revenge is not sweet .In fact its bitter .No body benefits. You are of course right to confront the artist about using your image. But in the eyes of the law you do need a model release if you put this image on a website.I imagine it must have been published in some form otherwise how did Peter Max get hold of it?

My friend, Louise, was at a Bob Dylan concert a fair few years ago. At one moment all the security goons were dealing with a disturbance at the opposite end of the security semi-circle so she took a chance, nipped over the guard rail, ran up to the stage and snapped a few pics - before she got nabbed and bodily flung back into the crowd.
She was overjoyed with her close-in photos when she got them back BUT a little while later a commercial poster came onto the market of EXACTLY one of her pics. No one else could have possibly got exactly the same pose from exactly the same position so she was well miffed.
Yes indeedy: it happens. There are some cheeky, unscrupulous bandits about. My sympathies. Sue them!
