What legal rights does a shopper have?

Thanks Steve.

I think that you know how bad I am with the art of simple stuff like

copy and paste....and my machine does not scan!
Could you kindly send an e mail to my e mail address....

a copy of what you just highlighted on here.

I will send it to the director and manager of the store in my

area and remind them.

Not looking forward to defending our situation....but I have lots of ammunition.

Barbara

Their customers service is more than bad.

Yes...I agree should be buying everything from specialist

shops...but not sure if I can afford to do that.

Supermarkets have buying power that is one of their attractions.

A would prefer to buy a John Derre...of course.

Just want to say that although Leclerc is not master of fruit and veg

their meat dept is certainly not bad...nor the fish...or cheese.

Plenty of good produce in St Foy Market but one or two stalls who really seem to think that they can pull the wool.

In an ideal world we would grow everything.....not living in an ideal world.

Lajarthe down near Jardiland do a good service and replace things that are not as they should be. We have never had reason to complain with them. Leclerc are simply as Véro says, what on earth they sell things that are out of their capability to deal with beats me.

Be very firm with them Barbara - Leclerc are just a supermarket, fine for loo-roll & washing gloop etc but they aren't specialists and are selling things they have no clue about & so don't want the hassle of dealing with justifiably angry customers when something goes wrong.

If you get a complete refund (ideal but unlikely) go & buy a sit-on mower from people who sell only sit-on mowers. Kubota on the St Laurent des Vignes roundabout by Leclerc in Bergerac are v good (no problems with my mower for the past 14 years).

I wouldn't personally buy any household appliance bigger than an electric hand-whisk or kitchen scales in a supermarket.

I am, infact going to see the Manager.

Customer Sevices are at the front desk at Le Clerc.

I do believe that going to the store is the answer...

I will ask for the sales team from the garden dept to be present

so that we can re cap on the whole problem....which began with

another ride on mower which was sold to us which was not complete...

componants missing.

Actually Le clerc have wasted a lot of our time and energy and, perhaps

the matter needs to go a little further than the front desk. Need to see

the big boys who live backstage.

I do appreciate your comments.

The retailer has only a "reasonable" responsibility (however one is supposed to interpret that), truthfully I would expect that to be 6-12 months, but it would also depend on the item purchased. Clearly the life (and hence retailer limited guarantee) on a £12 hand blender would not be the same as the life expectancy of a £500 TV. In saying that you must also read the the manufactures warrantee instructions as often it states time periods in which to return the goods to the retailer, or contact the manufacturer.

Many large retailers "BUY" the guarantee from the manufacturer, ie get goods cheaper if they take guarantee responsibility....they will not tell you this and will still try to "fob" you off telling you to contact the makers.....

I’ll check heck out link Haydn, possiblyall written in French! However is the French retailer (as supplier to customer) liable for 6 years, as was or is, in UK, irrespective of manufacturers warranty ?

Not every shop in the UK knows consumer law. I spent a long time in Tool Station demanding that they change a wallpaper stripper which had lasted 48 hours, and being told I would have to contact the manufacturers. They couldn't phone head office because it was a Saturday. I phoned head office on Monday and they agreed it was their responsibility and informed the branch. I got my replacement next time I went in.

Try contacting Leclerc Customer Service? There is a link on their website

Thank you Hadyn.

We seem to have come across a number of companies selling

goods not fit for sale and some very odd things happening with

delivery and setting up of appliances.

The cookers here seem to have a very short life and are their

components are put together really badly.

We had a legal insurance cover....but, to be honest I did a

much better job myself without having to wait for each of their

letters to reach us with negative outcome.

As for the store in question well we buy food from them, electrical

goods, garden furnishings, lap tops and even have hired cars from them.

So we do spend a few hundred euros each week and, perhaps that alone deserves

just a little client respect.

Sadly customer relations is a weak spot around these parts and it is not an asset to

the local community.

Do something right or not at all....

As you know ....or maybe not I have great hope for France in getting on her

feet some time soon.

But maybe there needs to be a few "charm schools"

Not all my memories of London are sad or gloomy and as far as stories

about supermarkets go my tale about Sainsbury in Cromwell road glows

with praise for the care they took with customers.

At one point the restaurant purchased whole fillet steaks from Sainsbury...

several at a time....we also took most of their venison saddle fillets.

They were of very good quality [ AND not crio vac packed.]

We had a problem on one occasion....I was at the store and said that we

were in trouble for that nights service...not enough fillet...they had let me down.

Late afternoon that day a taxi pulled up at the restaurant and the taxi driver

had a bag with him containing 2 whole fillet steaks which weighed around 7

kilos. He handed them to me....saying that he had been sent by Sainsbury s

in Cromwell Road.....those were the days!

Now to tackle Leclerc.

The law relating to sale of goods in France is virtually identical to that of the law in UK. Your contract was with the retailer do not let them fob you off..

Law can be found at :_

Thanks everyone.

Yes the machine was purchased as new.

As Brian said it seems like a case of can not be bothered....but I am bothering

to see the store manager next week when he returns from holiday.

It depends - sometimes the guarantee isn't covered by the shop but the manufacturer so they just send you to their siege and wipe their hands of the matter. Genrally speaking I would expect a motor to still be covered but not the blade

Find out from the manufacturer what their terms of guarantee are. A sit on mower would normally be two years, so I would be surprised if it is not. If it is a chain of some kind then find out where the store's regional office are and complain. I think you have a case of can't be bothered with customers that they must not be allowed to get away with.

If it was a new mower and the motor has a fault they should replace the motor as it should be under guarantee(usually 2years) however the blade maybe not. It seems very soon to require new blade if only purchased in March.

Was the machine new or used Barbara ?
