Mairie responsibility for upkeep of route communale

Does you neighbour use the side gate? If not, could you not approach them to discuss relinquishing their access to the ‘track’ leaving you with the opportunity to discuss outright purchase with the commune?

Yes, it was what we thought had been agreed (although this was handled by our estate agent so maybe it was not), but evidently the Marie has decided it should be as is and I am not so bothered about that. The neighbour does use the side gate a bit. But obviously would like the Commune to repair the bit they will still own and the rest of the road (ie proper road for access to other houses) is in reasonable state (tarmac) ). Having said that, we will have to do it ourselves if not, just trying to save the cost.

When a conseiller municipal, my OH was interested to discover that one particular inhabitant of the commune, known to the conseil as “la femme qui gueule” generally got whatever she wanted by way of repairs to the track leading to her house.

Well, here is an update. We just had a visit from the Maire and deputy. It’s changed again. They now say the commune will sell us the section of the road in front of our house for 1€ and they will pay the geomètre and notaire fees. Then there will be an exchange so our neighbour’s private road - already upgraded by the commune - will become the communale. Of course we don’t have to agree, in that case our section of the road would be resurfaced but it would remain communale and our neighbour and his visitors would use it to access their house and fields. Fait accompli.

Before you leap for joy just check what responsibilities and costs you will have as owner of that bit of road…

Since we will be the only users they can’t be excessive. Not exactly jumping for joy since it’s not what was promised.

Our Maire is a nice chap who wants to be nice to everybody, unfortunately he is easily leaned upon by the more forceful members of the community.

If you buy it… it should be yours alone… you can fence and gate it… thus it would only be you who would be using/degrading the surface etc etc… in the future.

Best to check that this will, indeed, be the outcome. ie the “bit of road” becomes your private “garden/land/whatever” with no rights-of-way or other tag-ons…

what about drainage… does it need drains ?? that could be a hefty cost…
where do water pipes and/or cables pass… will they be going underground… will that touch the road… ???
If water pipes are already in that bit of road, will they suddenly be your responsibility… as on your property…

think long and hard… and you’ll come up with the solution which suits you and your pocket.

Thanks Stella, certainly we’d want to check the final legal position but there are no drains, cables etc to think about, just maintaining the surface
