Partner of an EU citizen 18 month wait for Carte titre de sejour

Hi we went through a tough 10 months to get my cds family member of an eu citizen. (La Rochelle préfecture)
Firstly i know that only very recently you can apply online for the cds of an family member of an eu citizen. Before this it was impossible, I’m thinking you applied under the wrong category and this has delayed your application.
We sent 3 recorded letters had the mairie and french services chasing for us and also involved SOLVIT SOLVIT – EU rights problem solving when working, living or doing business in another EU country - European Commission
Solvit got things moving but still took a while.

Anecdotally on this forum, we are unfortunately seeing some fairly idiosyncratic recent rulings from prefectures concerning the EU family member CdS…do you have any theories as to why your case was so delayed? In principle individual prefectures (indeed individual countries) have very limited discretion with an EU CdS as it’s all supposed to be laid down at EU regulations level. Obviously that doesn’t preclude “bespoke” interpretations from prefectures…

I’d not come across SOLVIT before, and was v interested to see you’d involved them (as well as the Mairie and France Services). I see from your helpful link that SOLVIT don’t as a rule get involved in issues involving the UK post Brexit, but acknowledge they can help in individual cases that don’t involve the UK government. Interesting to hear what they actually did in case others going through this can benefit…

I have recently applied online Limoges for CDs as spouse of EU citizen ( Irish passport holder ).I did not wait as long but I think purely as I emailed haute vienne prefecture to chase. They asked me to send my and application and immediately scheduled an appt for fingerprints. Still waited another 10 weeks and chasing prefecture. Poor case worker advised she had approved but sitting on prefects desk awaiting signature.

They did only issue for 1 year even though I sent the EU directive stating it should be a minimum 5. I was just happy to receive though I may take it up when I physically collect card.

Ps have you looked too see if a Depot de Prolongation sent on Anef to confirm still legally here ?
