Unexpected Letter from HMRC

FFI is also known as SI 2009/226, which would tie in with being roughly around the date of the signing of the current tax treaty (which would be logical), so possibly 2008-2009. The FFI guidance was first published in 2014, ie the FFI must also have existed by that date. Therefore sometime in the 2008-2014 range if that helps.

You have to love HMRC. I got through after 30 minutes, was put on hold and then line goes dead. Got through after another 40 minutes. I asked when I could expect a reply to a letter sent in early February (following another call) asking them to sort out my tax on two pensions before I move permanently to France in June. He went to look it up and said I could expect a reply by 19th August. Was there anything we could do to prioritise it? No. Could he change my tax code? No.

Frustrating for you. I hope you get a sensible response when they do eventually reply.

Apologies for mentioning this if not applicable in your case…but I wondered if you were trying to persuade HMRC to issue you with NT (no tax) PAYE codes? Please ignore the following if this isn’t the case.

As you’re probably aware, HMRC are highly resistant to anticipating NT codes ahead of becoming non UK resident on items like pensions. Many have tried! HMRC generally want to see residence certificates from France/completion of Form France Individual before relenting and granting NT codes to exempt (mostly private sector) UK pensions from UK tax.

Same happened to me about 2 mths ago. Despite paying income tax in France for 20 years they sent me a letter saying I had underpaid last year and owed them £180.
I filled in a form online and explained 2 mths later I got a reply saying that the online form I used for my answer was not applicable and I had to phone. I haven’t phoned I can’t be bothered. I suspect a logic error in their system

It’s more complicated but yes I am trying to get a NT code and should have had one since 2022 when I first contacted them. I rang HMRC who sent me to DWP who sent me back to HMRC. The pension provider also said they could do nothing unless instructed.
I live in Belgium since 1996. An old company pension cut in 2020 at less than £1000pm so no tax. Then state pension in 2022 so I became liable for tax unless I had a NT code.
So I was hoping to at least get a NT code from beginning of this uk tax year.

That’s interesting. I wonder if that’s why hubby has also had tax deducted on his UK private pension. Like others, he’s been tax resident here for years, never had any issues with tax taken at source till last year. I wrote to the pensions office - they took FIVE MONTHS to reply! They sent a form which we completed, got the local tax office to stamp and then returned. Silence. And subsequently a pension which we moved from one provider to another has had a lump taken off in tax… We’ll be able to have a good party when he finally gets the money back!
