We’re both retired. Elderly parent needs me to be in UK more.

So what the tax man will probably ask next is whether you are both going to go back to the UK or whether your OH will stay in France.

To help you arrive at some of the answers to the questions helpfully posed by Sandcastle, you might find this interactive HMRC UK tax residence calculator useful. It can seemingly project forward up to a year ahead.

(As background, it gets more complicated if you are resident in the UK and also remain resident in France. That is where the UK /France tax treaty is involved, to determine in practice which country has the main taxing rights over you.)

Another thing to be aware of if you spend more than 6 months out of France you must hand back your Carte Vitale.

@kim maybe I completely missed it, but I’d appreciate it if you could help to clarify which documents will be required to exchange a 5yr WARP card for a 10yr card? And are there any minimum income requirements for this exchange?

There is no agreed nationwide procedure as yet. Some préfectures has issued guidance already, others haven’t. It will be via the préfecture so check what yours says.

But in general once you have been a legal resident for 5 years the income requirement falls away.

  • Passeport en cours de validité

  • Justificatif de domicile

  • 3 photos d’identité

  • Titre de séjour arrivant en fin de validité

I have been resident in France since August 2020. I have a WA Carte de Sejour that expires in May 2026. Can I apply now for permanent residency? And what does that actually mean, another 5 year CDS or a 10 year one.

I thought I had to register with ANF but have now been told I don’t need to as it doesn’t deal with WA cartes. I’m getting very confused.

It’s been covered on other threads here so best would be soend a bit more time and DYOR.

In a nutshell you can’t apply till 2 months before existing expires.

And unfortunately it won’t be centralised so applicants will be at the mercy of which Prefecture they come under as there is no centralised national process or platform. And as we relatively frequently on here see reports about various things where Prefectures appear to be off piste even in the light of national law, I think we just have to hope.

Only 2 or 3 prefectures appear to have put their process and its requirements on their sites too, so far

You are a permanent resident once you have lived here legally for 5 years, no matter what your card says.

How do you prove it? With the card?

Call your Prefecture two months before your 5yr card expiry. Prepare your dossier of the above and a new (free of charge) 10 year CdS will be issued.

When you applied for the card you put a date of arrival on the form. (Which nobody can remember, but it will be on record somewhere if they wish to check). That’s the start date of your 5 years. After that your tax returns prove you have been living here legally.

I’m always curious if that applies to me as I’ve been here just over 5 years, completely legally, but never done a tax return.

Though, to be honest, I’ll be happy if I finally get any carte de séjour.

Are there any plans for a centralized national process in the future, or is it expected that renewals will always remain under the control of individual Prefectures? My WA card expires in Nov 2026 so I’m hoping there will be some sort of application portal by then.

It’s such a small number that whether it is worth them bringing it into ANEF portal or not who knows. But I can’t see there ever being national consistency!
