French institution not refunded tuition fee

Dear Sir/Madam,

Regarding Refund of Tuition Fee.
After Applied visa in Jan,2020 hereby trying for refund of Tuition fee after refusal I have applied for visa in France high commission,Delhi,INDIA.
we are two students who paid tuition fee above 5790/each Euro as well as we paid non refundable registration charges 570/each Euro as well as but still did not received back at-least of tuition fee.we applied for institute ’ LYON INTERNATIONAL BUSINESS SCHOOL, Lyon, FRANCE’ Two Students named- HARPREET SINGH & HARIPAL SINGH
i’m already aware that college registration charges are non refund able but he should return tuition fee of both students .I/m continuously following institute since 12 months by mail and call.
please help me where i can contact regarding same or you do needful.

Does the school use social media? Because usually I find that Twitter is the most effective way to complain and get results.

A brief and polite Twitter message saying that you’re refund has not been made is likely to provoke a reply.

They will have sent you a contract, to which you agreed when you signed up and then paid the fees. I would imagine that the contract mentions the cases in which reimbursement of tuition fees can occur. I would also be quite surprised if the contract didn’t contain a list of very specific and limited reasons for any reimbursement. In particular, not obtaining a student visa in my experience is potentially not a valid reason for the school to reimburse you, as that is something the school generally has no control over. There might be also be a “force majeure” clause that allows the school to get out of reimbursing you due to the current pandemic.
Read the contract, seek legal advice on French contract law and whether the terms of the contract are enforcible and have been adhered to, and then decide where to go from there.

Dear sir,
I have already going through Study contract there is clearly mention ed about non refundable payment that’s only registration charges while college is not refunding tuition fee of amount 5790*2 as well .
still i did not get any mail regarding any commitment of transfer this payment in coming dates. they are replying only likely case has been forwarded into account department they will revert you . since 10 months we are awaiting .
A international officer Mr Spencer who was into our contact and shared activities on time of time of agreement with institution just not pick-up the phone He responded only once(in FEB 2020) that case has been forwarded to account department
They should give sensible revert at least . After all its disturbed our prospectus of future education. I’m afraid to say which type of institution is this …

If the school has any form of government sanctioned accreditation, you might try writing (in French) to the French Ministry of Education to mention the difficulties you are encountering in obtaining a satisfactory conclusion regarding your request. Maybe there is also some kind of public ombudsman for this kind of issue, unfortunately, I don’t know whether such an ombudsman exists.

My name is Gimhani Chamika…im from sri lanka…me also applied my student visa in 2021 for same institute Lyon International Business,Lyon.now almost 2 and 1/2 years…Still university didnt refund my university fees…even they didnt reply to my email…im really appreciate if someone can guide me to take legal action against to the university…

And i would like to know these two students mentioned in the first comment whether they got or not the university refund?

This isn’t the place for “guiding you to take legal action”. This is a discussion forum, not a legal aid forum, nor a forum dedicated to helping out foreign (non-French) students with their legal woes and allegations of malfeasance by the institutions to which they are making applications for registration.

Suggestions of which points to bear in mind and where to start looking have already been given in this thread.

I have no idea what happened to the previous people having asked questions, most of them just seem to turn up one day, ask one question and then leave, and don’t participate in this community, yet they expect some kind of ready-to-go solution to their problem in the instant that follows their question.

At the risk of appearing rude and uncaring, please read through the existing thread first before asking the same question as has already been asked. Perhaps, instead, you could ask yourself the following questions:

  • have I read the contract I signed with the business school ?
  • are there parts of it I don’t understand ?
  • have I contacted a French contract law specialist to clarify the parts I don’t understand, and determine whether I might have a cause of action ?
  • has the contract lawyer explained the various options open to me ?

If you fancy running the gauntlet of another forum, you can always try Reddit, there’s a specific France-related legal question subreddit over there, but be warned, you may get advice and recommendations from non-lawyers (these will generally have the attribute “PNJ” (personne non juriste) somewhere in their response. Perhaps you will encounter others over there that have had similar experiences to yours.

EDIT for further information: I sincerely hope that you didn’t book your place at the institution through a website such as this one - it seems that this is a 3rd Party intermediary based in the US, which clearly states that it doesn’t offer refunds for any monies you pay through their site. If you did, then you would have to consult with an American attorney-at-law.

I repeat @RicePudding’s advice to look at the contracf carefully. Ask a sensible admin-oriented friend to review it also as, as an independent person, they may see something you don’t.

It’s an école privée hors contrat avec l’état, the ministry of education will be of no help.

Did you submit your application direct to the school and deal directly with them throughout the process, or did you use an intermediary?
It seems strange me that you paid tuition fees in full in advance. I thought course fees were normally payable at the start of the course. When you apply you are reqired to show that you have the funding available but you are not asked to pay before the beginning of the academic year. Maybe some schools do it differently. But it does sound rather like a scam to me.

My son had to pay for his Master’s degree after the CAPES because he was well over 25 and had taken a couple of years out of university to work. The Academie here asked for four post dated cheques of €1000 each at the beginning of the year and they were cashed every quarter exactly which gave him time to work and put the money aside. He had official receipts and paperwork. This sounds like one of those dodgy establishments you see on Border Control programmes for Australia with people turning up from abroad with loads of paperwork but the places don’t actually exist or they are upto somthng else.

I recently paid for a postgraduate specialisation course upfront with the University of Strasbourg, so it is not at all uncommon to be asked to pay upfront.

Also means that the applicant is serious about doing the course too especially where there are limited places available.
