Humanitarian Hardship Request

Cross-post to hopefully get feedback for our current situation:

Looking for recommendations and if anyone experience with requesting a Humanitarian Hardship Travel Visa? I am an EU citizen and my husband is not and he’s been waiting for his carte de séjour to get approved since July 2026. He did however, get an Attestation de Prolongation D’ instruction where his initial 90 days have been extended through December 23. My mom is on hospice in the U.S. and I am her legal guardian and my husband is her POA and legal conservator. We need to travel back to see her as her passing is imminent. I can travel to the U.S and back to France however, my husband can not but we need to travel together given our legal responsibilities to my mom. We could take a chance and go see her and my husband may not be able to get on a plane in the U.S back to France. I have a letter from hospice, my marriage certificate and all relevant court documents as does my husband. We also saw that there was a law passed in 2003 that a spouse of a EU citizen could travel with me. I could print that information out as well. I read that if my husband submits this emergency request/humanitarian hardship request that it will not disrupt his carte de séjour application. Any advice would be appreciated. Many thanks.

Suggest you contact the relevant government departments for info. Don’t think this question would be able to be answered by us members of SF. Sorry but the majority of us are brits and would have no idea. Maybe start with your main prefecture where you live and ask them to help you. Good luck

Go now.

The rest you will just have to sort out later, contacting remotely if necessary.

How did your partner arrive in France in the first place? Ie does he already have a visa? I guess not if you are talking about 90 days extension.

Anyway, visa can be applied for at consulates in the US. Go now and sort it out later as if you have EU nationality then your partner can accompany you.

He didn’t need one as spouse of EU citizen.

I think George has provided the best possible answer in the other thread.

But, if push comes to shove I would just go - both of you. You’ve done what you should have done at this point. Have access to all the documentation provided to get the CdS which is in work. I think you will be OK.
