Could anyone help me understand if I am obliged (having bought a second-hand car from a professional garage 30 days ago) to return the car to the garage for a cancellation of the sale and refund? The car has had 3 significant problems and the latest one (a horrific noise which was too scary to drive with) means I left it sitting 150kms from me (300kms from the garage).
They have signed a ‘Reprise and Remboursement’ form but won’t reimburse me until I have returned the car. I am on foot, losing my income because I can’t get to work and have no way of getting back to where the car is. What can I do?
Thank you for any help or advice.
I think it’s one of those situations where you negotiate. It’s not the garage’s fault you’ve left the car 300km from it, and a 600km round trip to recover it will be a massive cost for them. It’s not your fault the car couldn’t be driven.
I’d expect any contract would require you to be responsible for returning the vehicle. Could you negotiate with the garage to share the cost? Would your insurance cover recovery?
Speak to your insurance company- you should be able to get it recovered.
Thank you so much, that’s really helpful - I was thinking about doing that so it’s good to have confirmation.
Thank you for the suggestion - turns out that the insurance company will only drop it off at a nearby garage - which of course us utterly useless to both parties.
What I would do is get the insurance to tow it to a main dealer for the marque, NOT just the closest garage, Ask them to assess the problem and based on that decide your course of action.
At the moment you have nothing to talk to the vendors about except an unspecified “horrific noise”. Which isn’t really isn’t a lot for them to go on, especially for a 600k round trip.
