Hi
Two people UK citizen and French want to get married(currently both are residents in France).
Can anyone advise on the legal pros and cons of doing it in one country over the other?
Inheritance and divorce issues if the later arises. You need to find out the pros and cons of these matters and how it could affect you especially where property is concerned. If you don’t want to get married, get PACS’d in France for tax purposes but if you have children, the father is not recognised unless he signs a special paper at the mairie statinghe is the biological father as my son had to do in both cases.
Thanks a lot for that information re PACS, but it’s not recognised in the UK as a marriage
In which cases would a heterosexual couple opt for it rather than for a marriage?
No children on both sides.
I’d appreciate any good lawyer recommendation too (pm me please)
Depending on the context, PACSis often seen in the UK as an equivalent to Civil Partnership, which in truth it isn’t as it’s a lot less of a commitment than either marriage or a UK Civil Partnership is.
In our case, our pension providers in the UK accepted our PACS as a Civil Partnership.
PACs is a lot easier to sort out if things go wrong.
Yes, isn’t it just a registered letter to each party saying they wish to terminate the partnership and then inform the mairie?
I’m not sure what precisely your question is as marriage is marriage no matter where it takes place. And each country has its rules for the treatment of married couples that don’t change according to where it happened. For ease of future administration it’s good to register the marriage in the country where it didn’t take place.
So once you have decided on marriage, rather than PACS or civil partnership, then need to consider the marriage regime. In the UK the default is separation des biens. In France there are choices to be made. See here
I quite like this summary of marriage regimes - it seemed even clearer to me!
EDIT: Ooops forgot the link! Here it is
