I wonder whether there is more of a backstory? Mostly from what I have read the préfectures are lenient on first renewal if the income is below SMIC, and give another year for people to get their businesses up to speed, and also give weight to people’ plans to develop their income. So if that is her case and she hasn’t been able to improve her turnover, nor give a credible plan to do, then they are in the weeds. Those are the rules for an entrepreneur/prof liberale visa.
(if the husbands’ income was sufficient for two then that would probably be allowed, but seems that it isn’t.)
Technically, for an entrepreneurial visa, you need to be fully self-sufficient through the business that justified the visa but I don’t know how firmly that rule is applied.
Just shows that people applying for Visas really must have sufficient financial backstop to keep them going during the first few years.
This lady arrived in December 2024 and is already “in the mire” with such a ghastly backlash.

The operative word here is VISA. Unfortunately brexshite caused a lot of problems for people wanting to move here on a whim like most of us did when even a CDS wasn’t obligatory (it was when I came here to live full time and we had to get one as we did a French driving licence too) I don’t think anyone with a CDS needs to worry as these rules do not apply but it should be a warning to folks thinking of coming to live and those stupid place in sun programmes that glamorise French living to do their homework and find out if it is possible first before they jump in. We do not know all the details either.
She has her business so an entrepreneurial visa is correct. She will have had to submit a business plan, and if on visa renewal she is not meeting here business plan targets then she is in trouble. It is entirely possible that she is so far off target that they are not prepared to be lenient. We don’t know.
I agree. But one would like to think that if it was just a small top up required they would accept this. But perhaps his finances are equally precarious.
There was a similar case a while back wasn’t there? - Anyone know what ultimately happened to that one?

and, of course, they sold up everything to come to France… aaargh
Here on the forum, we always advise folk to check and double check that they can fulfil the demands/commitments of whatever visa. Personally I don’t think someone should sever all ties with UK before they know things will work out OK in France.

There were on second renewal, and had already been given a year’s leniency. But don’t know if they succeeded on appeal.
To be accurate it says “to apply for another visa”. There is no mention that what she has is not correct for her situation.
Ah.. I took it to mean another (un autre/a different) if she can’t fulfil/meet-the-requirements of the one she has..
seems a bit pointless to rehash and perhaps be in the same situation in 1 year’s time.
whatever, I reckon none of us would want to be in her situation.. so let’s hope it all turns out ok.
